These Terms of Use ("Terms") govern your use of the Horizon Alert iOS application and this website (together, "the Service"). By downloading, installing, or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
1. The Service
Horizon Alert provides informational alerts about astronomical and orbital events — including rocket launches, International Space Station passes, eclipses, and meteor showers — and estimates of their visibility from your approximate location based on factors such as timing, sun position, and forecast cloud cover.
2. Informational use only — no guarantees
Event times, orbital predictions, and weather-based visibility are estimates derived from third-party and public data. They can be delayed, changed, or wrong. Launches scrub or slip. Clouds roll in. Forecasts miss. We do not guarantee that any event will occur, occur on time, or be visible from your location.
Do not rely on the Service for any purpose where inaccuracy could cause harm or loss. The Service is provided for general interest and enjoyment, not for navigation, aviation, scientific, safety-critical, or professional use.
3. Safety
You are responsible for your own safety while using the Service. Never observe the sky while driving or operating machinery. Never look directly at the Sun without proper certified solar filters, including during a partial eclipse. Choose safe, legal places to observe, and be mindful of your surroundings.
4. License
Subject to these Terms and your purchase through the App Store, we grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial use, in accordance with the Apple Media Services Terms and Conditions.
5. Acceptable use
You agree not to: (a) reverse engineer, decompile, or attempt to extract source code except where permitted by law; (b) interfere with or disrupt the Service or the third-party data sources it relies on; (c) use the Service in violation of any applicable law; or (d) resell, redistribute, or sublicense the Service.
6. Purchases
Horizon Alert is a paid application sold through the Apple App Store. All purchases, pricing, billing, and refunds are handled by Apple and governed by Apple's terms. We do not process payments and have no access to your payment information.
7. Third-party data and services
The Service incorporates publicly available data and services from third parties, including launch providers, orbital data sources, weather/forecast providers, and Apple Maps. We are not responsible for the availability, accuracy, or content of third-party data or services, and their use may be subject to their own terms.
8. Intellectual property
The Service, including its design, code, and branding, is owned by us or our licensors and is protected by applicable intellectual-property laws. These Terms grant you no rights to our trademarks or branding.
9. Disclaimer of warranties
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law.
10. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of or inability to use the Service, including reliance on event timing or visibility estimates. Where liability cannot be excluded, it is limited to the amount you paid for the app.
11. Changes
We may update these Terms from time to time. We'll revise the date above and, where appropriate, note material changes in an app update. Continued use after changes take effect means you accept the revised Terms.
12. Termination
You may stop using the Service at any time by deleting the app. We may suspend or terminate access if you materially breach these Terms.
13. Governing law
These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws rules. Any dispute not subject to arbitration or small-claims court will be brought in the state or federal courts located in Texas. Nothing here limits any non-waivable consumer rights you may have under your local law.
